The APM Hong Kong branch held their latest event entitled Mock mediation on the 19th October 2010 at Hong Kong Yacht Club. The event simulated a dispute involving a contractor and the incorporated owners of a residential building for building works. The contractor was claiming additional time and money and reimbursement of liquidated damages imposed. In return, the opponent alleged defective and late works.

Mr Ivan Cheung acted as the mediator, Mr James Lee as the claimant, Mr Thomas Ho as the defendant, Ms Alice To as solicitor for the defendant and Mr Seymour as moderator for the evening.

In helping the parties settle their dispute, the mediator demonstrated the following points:

  • Establishing authority to settle
  • Setting ground rules
  • Separate caucuses
  • Parties' bottom lines
  • Worst case scenarios
  • Reaching a compromise
  • Exploring strengths and weaknesses in the parties' cases

The mediator helped the parties understand their respective cases and explore their options to achieve an agreeable result.

The mock mediation was then followed by a lively Q&A session.
