New initiatives in the resolution of construction and engineering disputes

A significant competence of a project manager is conflict management; the ability to identify, address and resolve differences between individuals and interest groups.

Sometimes this requires use of a formal, established framework to resolve the situation in question. This is where industry standard solutions come in to play. As a professional, it is important, therefore, to have knowledge and understanding of them and their place in our portfolio of tools.

The Construction Industry Council (CIC) Alternative Dispute Resolution (ADR) Management Board undertakes activities which minimise the financial and emotional costs of construction and engineering disputes, and it is responsible for the development and publication of CIC guidance and procedures in relation to ADR.

As his second three-year term as Chair of the CIC ADR Management Board draws to a close, Niall Lawless will discuss some important CIC ADR initiatives. These include the CIC Model Mediation Agreement and Procedure (CIC MMAP) published in June 2019, and the CIC Low Value Disputes Model Adjudication Procedure (CIC LVD MAP) to be published in March 2020.

Niall Lawless is a Chartered Arbitrator and Engineer, Adjudicator, Mediator of international reputation and experience. He has a long history of leading and contributing to learned and professional bodies engaged in setting ethical and professional standards and dispute resolution.
